1. Acceptance of Terms

By downloading, installing, or using WaterWays NZ ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the App.

2. Description of Service

WaterWays NZ provides marine chart visualisation and GPS navigation features for recreational use in New Zealand waters. The App displays hydrographic data sourced from Land Information New Zealand (LINZ) and other publicly available datasets.

3. Not a Substitute for Official Charts

WaterWays NZ is not an official navigational chart and must not be used as a primary means of navigation. The App is intended as a supplementary tool for recreational boating only. Always carry up-to-date official charts and use proper navigational equipment. We accept no liability for navigational decisions made using the App.

4. Accuracy of Data

While we make every effort to ensure chart data is accurate and current, we do not guarantee the accuracy, completeness, or timeliness of any information displayed in the App. Seabed conditions, navigation aids, and coastal features change over time.

5. Subscriptions & Payments

Some features of the App require a paid subscription. Subscriptions are managed through the Apple App Store or Google Play Store and are subject to their respective terms. Subscription pricing is displayed in the App before purchase. You may cancel your subscription at any time through your device's store settings.

6. User Accounts

You are responsible for maintaining the security of your account credentials. You must not share your account or use another person's account without permission.

7. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Attempt to extract or redistribute the chart tile data
  • Use the App for any unlawful purpose
  • Interfere with or disrupt the App's servers or services

8. Limitation of Liability

To the fullest extent permitted by New Zealand law, WaterWays NZ and its developers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to property damage, personal injury, or loss of data.

9. Intellectual Property

The App, its design, code, and branding are the intellectual property of WaterWays NZ. Chart data sourced from LINZ is used under the CC BY 4.0 licence.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
